Lawyer files FR petition

The Supreme Court granted leave to a fundamental rights application filed by a lawyer against non-disposal of garbage in Colombo city.

Following the application filed by Attorney-at-Law, Kanchana Piyadasha, the legal officer of Lawyers for Human Rights and Development, the Supreme Court bench comprising Justices, Dr. Shirani Bandaranayake, Saleem Marsoof and Jagath Balapatabendi granted leave and issued notice on the respondents.

The petitioner has cited Colombo Municipal Council, the Mayor, Chief Minister of the Western Province, Reginald Cooray, Minister of Environment, Champika Ranawaka and ten others as respondents.

Supporting the application, counsel Kalyananda Thiranagama said the petitioner along with other citizens who were coming to the capital Colombo suffer frequently from failure to remove the garbage and solid waste from the streets in Colombo.

He stated as a result of the negligence of the authorities, the health of the public was in danger and they suffered due to the emanation of offensive odour.

 He claimed that along with the public he was entitled to continue their life without adverse effects of the garbage and the solid waste.
