Notice issued on Defense Secretary and four others
The High Court of Vauniya after examining a petition filed by Nadaraja Padkunam of Batticaloa in the Vavuniya High Courts requesting Court to issue an order for the release of his son Pathkunam Gajan (20) who has been detained without any charges at the Pambamadu refugee camp, or to institute legal action duly, the Court issued notice on four persons including defense secretary Gotabaya Rajapakse and the Pambamadu refugee camp Commanding officer Major General Rohan Hettiweera.
This habeas corpus application was examined by the Vavuniya High Court judge J. Viswanathan.
Initially, the petitioner’s son was abducted by the LTTE on the 25th of January 2007 when he was on his way to School, and enrolled into the LTTE medical Force. After medical training at the Mallawi hospital, when he was serving in the Mancholai Hospital, while he was being transported to the Marvil aru District he fell victim to a shell attack , and he was admitted to the Pudhukudiruppu Ponnamabalam Hospital.
The petitioner in his application has claimed that his son who is now detained at the Pambamadu camp, is, as far as he knows is being held without any charges being filed. Therefore, he had requested Court for an order to have his son restored to him, or if there are any charges, legal action is instituted without keeping him in detention indefinitely.
